Telemarketing calling hours by state

The TCPA allows sales calls from 8 a.m. to 9 p.m. local time. Some states are stricter. Pick a state to see its window, its Sunday and holiday rules, and whether it is open right now.

The list covers states whose telemarketing hours or days are narrower than the federal 8 a.m. to 9 p.m. window. A state missing from this list may still have rules of its own.

How to stay inside the window

Schedule by the lead's state, not your office. The safe default for a national list is the strictest common window: 9 a.m. to 8 p.m. local time, Monday to Saturday, then add the state exceptions above. Remember that people keep their numbers when they move, so the area code is a starting point, not proof of where someone lives.

To see each number's local time from its area code, paste your list into the free calling hours checker.

Every dial inside the window should reach someone

A tighter window means fewer hours to dial. Disconnected numbers, landlines on an SMS list and VoIP lines burn those hours, and they only show up with a live carrier lookup.

Drop the dead numbers before the window opens

Questions

What are the federal TCPA calling hours?

The FCC's TCPA rules (47 CFR 64.1200(c)(1)) bar telephone solicitations before 8 a.m. or after 9 p.m. at the called party's location. The FTC's Telemarketing Sales Rule sets the same window. That is the outer limit everywhere in the US.

Which states have stricter calling hours?

Several states narrow the window, most often to 8 a.m. to 8 p.m. (for example Florida, Maryland, Oklahoma and Washington). Some also bar calls on Sundays or holidays, such as Alabama, Louisiana, Mississippi, Rhode Island and Utah, and Texas allows Sunday calls only from noon. The table on this page lists the ones we cover.

Whose time zone counts, mine or theirs?

Theirs. Both the federal rule and the state rules are measured in the called person's local time, so a 7:30 p.m. call from New York lands at 4:30 p.m. in Seattle but 8:30 p.m. would already be too late in Florida under its 8 p.m. cutoff.

Do these rules apply to texts?

Often, yes. The FCC treats text messages as calls under the TCPA, and some newer state laws, such as Florida's and Pennsylvania's, expressly cover marketing texts. Plan your SMS sends inside the same windows.

Is a state not on this list free of rules?

No. This page covers states whose hours or days are narrower than the federal window. Other states can have registration, disclosure or Do Not Call rules, and laws change. Check the current statute and review your process with counsel.

Does TrueSearch check the Do Not Call registry?

No. TrueSearch for Business checks whether numbers are valid and their line type and carrier. For Do Not Call status, use the National Do Not Call Registry at donotcall.gov.

This guide is general information, not legal advice. TrueSearch for Business checks validity, line type and carrier from licensed telecom data. It does not check the National Do Not Call Registry, state DNC lists or the FCC Reassigned Numbers Database. Not a consumer reporting agency; not for FCRA purposes.
